Leeming Bar PSPO – Lisa Dixon Fails Again?

Since announcing Leeming Bar PSPO – Fixed Penalty Notices Suspended Councillor Carl Les, who is a Hambleton District Council (HDC) Councillor for Leeming Bar and Leader of North Yorkshire County Council, Steven Lister, HDC Director of Leisure and Communities, and their legal advisors have been noticeable by their collective silence.

It appears that they require further information to do the right thing and revoke the Leeming Bar Industrial Estate and surrounding areas Public Spaces Protection Order (PSPO). I am happy to assist.

  • Road Traffic Regulation Act 1984 

I refer Steven and Carl to the Road Traffic Regulation Act 1984 – 64 – 1 which states:

“In this Act “traffic sign” means any object or device (whether fixed or portable) for conveying, to traffic on roads or any specified class of traffic, warnings, information, requirements, restrictions or prohibitions of any description

Remaining overnight in a vehicle is prohibited in the PSPO. Looks like Steven and Carl have got it wrong.

All traffic signs on the Highway must be contained in the Traffic Signs Regulations and General Directions 2016. The Leeming Bar PSPO signage is not.

  • Anti-social Behaviour, Crime and Policing Act 2014

The Anti-social Behaviour, Crime and Policing Act 2014 – 65 – 1 states:

” A public spaces protection order may not restrict the public right of way over a highway.”

The PSPO restricts the public right of way over a highway. The PSPO should never have been introduced. Looks like Steven and Carl are wrong again.

Lisa Dixon Connection

I am informed that Scarborough Borough Council is responsible for the drawing up and enforcement of the Leeming Bar Industrial Estate and surrounding areas Public Spaces Protection Order.

Does this mean that Lisa Dixon, Scarborough Borough Council (SBC) Director of Legal & Democratic Services is presiding over unlawful PSPOs at Scarborough and Hambleton?
